Unless agreed to the contrary by Flooring World and the Customer in writing, payment for the goods must be made by the Customer in full before the goods leave the premises of Flooring World or Flooring World has the right to suspend or cancel any contract and/ or delivery to supply goods to the Customer. If the Customer defaults in payment of any moneys, Flooring World has authority to require the Customer to pay interest Flooring World on the amount outstanding at the rate of 4% per annum higher than the rate for the time being fixed under section 2 of the Penalty Interest Rates Act 1830 (Vic) computed upon the period of the default. The Customer cannot make any reduction from the price of the goods or claim any offset or counter claim against Flooring World. Payment is either by bank transfer, cheque or cash payment on pick up.
Orders:
The Customer agrees that each order it places shall be deemed to include a representation that it is solvent and able to pay all of its debts as and when they fall due. Any failure to do so shall be deemed to create or constitute an inequality of bargaining position, the taking of an unfair advantage of Flooring World and to be unconscionable, misleading and deceptive.
Purchase price:
Purchase price for the goods and services shall be the price provided to the Customer by Flooring World at the time of ordering the goods, unless otherwise agreed by Flooring World and the Customer. Despite our diligent efforts, a small number of items on our web site may be incorrectly priced from time to time. Rest assured that we will verify all prices as part of our shipping procedures and provide you with correct pricing in your order confirmations, if a price discrepancy occurs. Flooring World reserves all rights to correct any errors in the online system prior to shipping and billing. If you suspect an error in pricing, please contact our Customer Service Department.
Delivery:
Delivery is by arrangement only. Delivery charges apply. Please call (03) 9706 9070 for a shipping quote and to arrange delivery. Shipping charges vary depending on your postcode, total size and weight. Delivery is carried out by various contract couriers according to area, size and weight of the order. Sample packs are sent via Aust Post at the cost stated on the website. Delivery dates given by Flooring World are approximate only and Flooring World accepts no responsibility or duty to deliver. However, Flooring World may elect to arrange delivery at it’s discretion at the Customer’s cost even if the delivery is late. Flooring World will not be liable for any claims, loss or expenses incurred as a result of delay and failure to deliver the goods.
Pricing:
All prices for flooring is charged per square metre. All prices for aluminium trims and moulding is charges per linear meter. All underlay is charged per roll.
Entire Agreement:
These Terms constitute the entire agreement between Flooring World and the Customer and supersede all prior representations, contracts, statements and understandings whether verbal or in writing. All other terms and conditions are excluded to the fullest extent permitted by law including any terms and conditions which the Customer may seek to impose.
Returns:
Any return of goods must first be approved by Flooring World and no returns will be accepted after 30 days from purchase. Flooring World is under no obligation to provide a refund or a credit for goods purchased. Flooring World may elect to accept a return of goods where the goods are in the same order and condition as they were in when supplied to the Customer. In the case when an item is found to be faulty, it is Flooring World’s discretion to either repair or replace the faulty item, and the Customer must pay all costs relating to the transport/shipping of the returned goods back to the place of purchase.
Customer Warranty:
All products sold may be resold to buyer only in packages supplied by Flooring World and any trademark and logo other than those applied by Flooring World be marked on or applied in relation to Products without prior written consent of Flooring World.
Force Majeure:
Flooring World shall not be liable for any failure to perform or delay in performance of the contract by reason of, whether wholly or in part, any circumstances beyond its control.
